SurfPhoto Marketplace — Terms of Service

These Terms of Service govern your use of SurfPhoto Marketplace ("the Platform"). By using our service, you agree to these terms.

1. Account Registration

• You must be at least 18 years old to create an account.
• Provide accurate, current, and complete information.
• You are responsible for maintaining the security of your account.
• One account per person; no sharing or transferring accounts.

2. Uploader Obligations

• Content Ownership: You must own or have rights to upload all photos.
• Content Standards: Follow our Content Policy. No nudity, minors, or copyrighted material without permission.
• Pricing: Set fair, reasonable prices for your photos.
• Quality: Ensure photos meet minimum quality standards.
• Attestation: Confirm you have rights to upload each photo.

3. Buyer Obligations

• License Compliance: Follow the Buyer License terms.
• Payment: Pay the listed price before downloading.
• No Redistribution: Do not share, resell, or redistribute purchased photos.
• Respect Copyright: Do not claim ownership or remove watermarks.

4. Payment & Payouts

• Stripe Processing: All payments processed securely through Stripe.
• Uploader Payouts: 80% of sale price paid to uploader via Stripe Connect.
• Platform Fee: 20% retained for platform costs and development.
• Payout Schedule: Payouts processed within 3-5 business days.

5. Prohibited Activities

• Uploading content you don't own or have rights to.
• Attempting to circumvent watermarks or security measures.
• Harassment, hate speech, or abusive behavior.
• Attempting to manipulate the platform or payment system.
• Creating multiple accounts to avoid restrictions.

6. Content Moderation

• We reserve the right to review and moderate all content.
• Photos may be quarantined or removed for policy violations.
• Repeated violations may result in account suspension or termination.
• Appeals process available for moderation decisions.

7. Intellectual Property

• Uploaders retain copyright to their photos.
• Buyers receive limited personal-use license only.
• Platform retains rights to display and promote content.
• No transfer of ownership occurs through sales.

8. Termination

• We may terminate accounts for policy violations.
• You may delete your account at any time.
• Content may be retained for legal compliance.
• Outstanding payouts processed within 30 days.

9. Disclaimers

• Platform provided "as is" without warranties.
• We are not responsible for content uploaded by users.
• No guarantee of photo quality or suitability.
• Platform availability subject to maintenance and updates.

10. Limitation of Liability

• Our liability limited to amounts paid for services.
• Not liable for indirect, incidental, or consequential damages.
• Exceptions for gross negligence or willful misconduct.

11. Changes to Terms

• We may update these terms with notice.
• Continued use constitutes acceptance of changes.
• Material changes will be communicated via email.

12. Governing Law

• These terms governed by applicable law.
• Disputes resolved through binding arbitration.
• Class action waivers apply.
